NAGPUR: Principle district judge of Gadchiroli SS Ahmed has rapped the prosecution and questioned the police action against Arun Ferreirawhile granting him bail on a personal bond last week. Ferreira had been acquitted in nine cases in September. Moments after his release from jail, he was arrested for an offence registered in 2007 at Purada police station. The court observed that the reason for arresting Ferreira after such a long gap was not clear.
In the conditions for bail, the court has asked him to furnish a personal bond of Rs 50,000 in view of the serious charges against him and his Naxal links. Ferreira has to also present himself before the local police station regularly. He also has to inform the police about his residence and furnish his address.
The bail order also points out that the other accused in the same case have been acquitted, said Ferreira’s counsel advocate Jagdish Meshram. He said the court has also mentioned that nothing has been seized from Ferreira in the case and nothing is there for seizure too.
“The court has passed the order of bail in the interest of justice after detailed records were perused by it,” said Meshram. He also said that the case would now be conducted in Gadchiroli while another case slapped against Ferreira, also by Purada police, would be tried at Nagpur.
“The prosecution argued that the surrendered Naxals gave statements that Ferreira was involved in the offence, so he was arrested. The defence had objected by saying that his name did not feature in the first charge sheet and there was no clear indication of his presence at the site of offence too,” the counsel said.
Ferreira had been earlier acquitted in four cases of Chichgarh police station, two of Salekasa, both in Gondia, along with two of Dhantoli police station in Nagpur. He has also been acquitted in a case against him by Chandrapur police. Ferreira’s arrest from outside the jail by Gadchiroli police too attracted criticism.
