Subject : Regarding obtaining permission to arrest accused Arun Thomas Ferreira Age. 38 ears R/o. Mumbai Bandra in the offence of P.S. Purada C.R.No. 0023/07 V/s. 307, 143, 147, 148, 149, 353, 120 (B) IPC, 3/25 Ind. Arms Act.

      It is humbly submitted that, the brief facts of th said offence are that on 24/4/2007 when the complaint N.P.C. 1542 Tukaram Gawade, SOg, Gadchiroli was searching the area from Jafraghad hills to Betagathi area road alongwith his Police party, at around 06.45 in the morning, Naxalite accused assembled unlawfully, conspired against the government, indiscriminately fired on the Police party with the object of killing them and created obstacles in Government work and then when the Police party too fired in retaliation in the direction of the Naxalities in self defense, the Naxalites filed using the cover of the forests after seeing the increasing police pressure and that on such report of the complainant the above offence was registered against Naxal accused at P.S. Purada (A.O.P.) Bedgaon and taken up for investigation.

      Accused in the said offence namely Arun Thomas Ferreira Age 38 years R/o. Mumbai, being arrested in the Naxal offence of P.S. Purada C.R.No. 0014/07 v/s 307, 353, 143, 147, 148, 149, 120(B) IPC, 3/25 Ind. Arms Act he has been sent to MCR from your court. Further, prior to this, four accused having being arrested in the said offence, chargesheet has been filed v/s 299 in this Hon’ble Court against arrested accused and other absconding accused and the accused referred to in the above subject.

      The said accused referred to in the above subject being a member of Maharashtra State Naxal Committee, his active involvement in the said offence has been disclosed from the Statements of witnesses. Further, the name of the said accused is mentioned in the chargesheet as Accused No.4 in the column of accused v/s 299 CrPC.

      Hence request to grant permission to arrest the above mentioned accused in the said offence as it is necessary that he be interrogated regarding the offence for the purpose of investigation in the said crime.
